Terms and Conditions – EURO JOE

Article 1. Applicability

These general terms and conditions apply to all our offers and all agreements concluded by us, regardless of their nature. They specifically apply to agreements for the supply of goods to our buyers.

The term “buyer” refers to any natural or legal person in a contractual relationship with us based on a purchase agreement or seeking to enter into any such agreement. This also includes anyone on whose behalf goods are delivered.

Any deviation from these terms is only valid if expressly agreed in writing.

If the buyer refers to their own general terms and conditions, these will not apply unless explicitly accepted by us in writing. In case of conflict, our terms shall prevail.

“Delivery of products” also includes performing services or work of any kind.


Article 2. Offers

Our offers are non-binding invitations to make a proposal, unless explicitly stated otherwise in writing. A buyer’s order constitutes an offer, which is only accepted after our written confirmation (order confirmation).

All documents (designs, models, descriptions) attached to the offer remain our property and may not be copied or disclosed to third parties without our written consent.


Article 3. Formation of the Agreement

An agreement is concluded when we confirm the order in writing. The buyer is bound by their order for 8 days from its date.

Our order confirmation is deemed accurate and complete unless disputed in writing by the buyer within 8 days.


Article 4. Prices

Our prices include VAT unless otherwise agreed in writing and exclude packaging, transport, and other costs.

We reserve the right to adjust prices if cost factors (exchange rates, raw materials, taxes, transport) change between order confirmation and delivery.


Article 5. Delivery and Deadlines

Indicated delivery times are approximate and not binding. Delivery is free of charge for orders above €150 unless otherwise agreed.

Below this amount or for special delivery requests, shipping costs are borne by the buyer. The buyer must accept delivery within the agreed time frame or risk additional charges or cancellation.


Article 6. Complaints

Visible defects must be reported in writing (by registered letter) within 14 days of delivery, including a detailed description and invoice number. Hidden defects must be reported within 14 days of discovery.

The right to complain lapses if:

  • the notification is late or not in writing;

  • the buyer does not cooperate in the investigation;

  • goods have been mishandled, misused, or modified;

  • the warranty period has expired (max. 6 months after delivery).


Article 7. Liability and Return Policy

We are only liable for defects caused by manufacturing or material faults unless the warranty is assumed by a third party.

Colors may differ from photos. Return shipping is always at the buyer’s expense.

Right of Withdrawal:
The buyer may return products within 14 days of receipt without giving any reason, except for excluded items listed below. The full order amount including initial shipping costs will be refunded within 14 days after receiving the return. Return shipping costs are borne by the buyer. Products must be returned unused, undamaged, and in original packaging.

Exclusions:

  • Customized products (e.g., embroidery)

  • Products made according to customer specifications

  • Products that cannot be returned due to their nature

Important addition:
Products on promotion cannot be returned.


Article 8. Retention of Title

Delivered goods remain our property until full payment has been made. The buyer may not pledge or transfer ownership before payment is complete.


Article 9. Payment

Payment must be made within 7 days of the invoice date unless otherwise agreed in writing. Late payment will result in interest charges and collection costs.


Article 10. Force Majeure

In the event of force majeure (war, natural disasters, strikes, government restrictions, internet failures, etc.), we may suspend or cancel the agreement without liability for damages.


Article 11. Applicable Law

Belgian law applies to all our offers and agreements.


Article 12. Disputes

All disputes shall be settled by the competent court in Ypres, Belgium.
